Business Loan Program Temporary Changes; Paycheck Protection Program-Revisions to Loan Amount Calculation and Eligibility

This interim final rule implements changes related to loans made under the Paycheck Protection Program (PPP), which was originally established under the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) to provide economic relief to small businesses nationwide adversely impacted by the Coronavirus Disease 2019 (COVID- 19). On December 27, 2020, the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (Economic Aid Act) was enacted, extending the authority to make PPP loans through March 31, 2021, revising certain PPP requirements, and permitting second draw PPP loans. This interim final rule allows individuals who file an IRS Form 1040, Schedule C to calculate their maximum loan amount using gross income, removes the eligibility restriction that prevents businesses with owners who have non-financial fraud felony convictions in the last year from obtaining PPP loans, and removes the eligibility restriction that prevents businesses with owners who are delinquent or in default on their Federal student loans from obtaining PPP loans.

This AD was prompted by reports of loose elevator torque tube attach fasteners. This AD requires repetitively inspecting the inboard and outboard elevator torque tube attachments for loose or incorrectly installed fasteners, replacing all fasteners if loose or incorrectly installed fasteners are found, and reporting the inspection results to the FAA. This AD also includes optional actions to terminate the repetitive inspections. The FAA is issuing this AD to address the unsafe condition on these products.

On January 23, 2020, the Illinois Environmental Protection Agency (IEPA) submitted a request to amend the provisions of the Multi-Pollutant Standards Rule in the Illinois regional haze SIP. EPA is proposing to approve the revision because it will result in a significant decrease in emissions of NOX and SO2, meets the applicable requirements of the Clean Air Act (CAA), and does not interfere with any applicable requirement concerning attainment and reasonable further progress.

The submission revises Missouri_s regulation that restricts the emissions of volatile organic compounds from wood furniture manufacturing operations in St. Louis City and Jefferson, St. Charles, Franklin, and St. Louis Counties. Specifically, the revisions to the proposed rule specify that this proposed rule only applies to sources that were existing at the time of the rule_s promulgation, remove the unnecessary use of restrictive words, update references, and make minor clarifications and grammatical changes. These revisions do not have an adverse effect on air quality. The EPA_s proposed approval of this proposed rule revision is being done in accordance with the requirements of the Clean Air Act (CAA). Approval of these revisions will ensure consistency between state and federally- approved rules.

In this document, the Commission seeks comment on whether it could add a new Mobile allocation or expanded terrestrial service rights in 500 megahertz of mid-band spectrum between 12.2-12.7 GHz (12 GHz band) without causing harmful interference to incumbent licensees. Assuming the Commission could do so, it seeks comment on whether that action would promote or hinder the delivery of next-generation services in the 12 GHz band given the existing and emergent services offered by incumbent licensees. The Commission proceeds mindful of the significant investments made by incumbents and values the public interest benefits that could flow from investments made to provide satellite broadband services, particularly in rural and other underserved communities that might be more expensive to serve through other technologies. The Commission believes that it is appropriate, however, to initiate a rulemaking proceeding to allow interested parties to address whether additional operations can be accommodated in the band while protecting incumbent operations from harmful interference and for the Commission to assess the public interest considerations associated with adding a new allocation.

The Petitioner requests the substitution of channel 27 for channel 12 at Augusta, Georgia in the DTV Table of Allotments. In support of its channel substitution request, the Petitioner states that the Commission has recognized that VHF channels have certain propagation characteristics which may cause reception issues for some viewers, and also that the ``reception of VHF signals require larger antennas . . . relative to UHF channels.__ According to the Petitioner, ``many of its viewers experience significant difficulty receiving WRDW-TV_s signal__ and its channel substitution proposal will allow WRDW ``to deliver a more reliable over-the-air signal to viewers.__ The Petitioner further states that operation on channel 27 will not result in any predicted loss of service and would result in a substantial increase in signal receivability for WRDW viewers. We believe that the Petitioner_s channel substitution proposal warrants consideration. Channel 27 can be substituted for channel 12 at Augusta, Georgia as proposed, in compliance with the principal community coverage requirements of section 73.625(a) of the Commission_s rules at coordinates 33-24-37.0 N and 81-50-36.0 W. In addition, we find that this channel change meets the technical requirements set forth in sections 73.616 and 73.623 of the rules.

This deviation will test a change to the drawbridge operation schedule to determine whether a permanent change to the schedule is needed. The Environmental Protection Agency (EPA) is making an interim final determination that the Arizona Department of Environmental Quality (ADEQ) has submitted rules and other materials on behalf of the Pinal County Air Quality Control District (PCAQCD or District) that correct deficiencies in its Clean Air Act (CAA or Act) state implementation plan (SIP) provisions concerning ozone nonattainment requirements. This determination is based on a proposed approval, published elsewhere in this Federal Register, of PCAQCD_s reasonably available control technology (RACT) SIP rules and negative declarations. The effect of this interim final determination is that the imposition of sanctions that were triggered by a previous partial disapproval and limited disapproval by the EPA in 2019 is now deferred. If the EPA finalizes its approval of PCAQCD_s submission, relief from these sanctions will become permanent.

The FAA proposes to supersede Airworthiness Directive (AD) 2016-08-20 for certain Airbus Helicopters (previously Eurocopter France) EC130B4 and EC130T2 helicopters. AD 2016-08-20 requires repetitively inspecting the tail boom to Fenestron junction frame (junction frame) for a crack. Since the FAA issued AD 2016-08-20, additional cracks have been reported and a design change that modifies the junction frame has become available. This proposed AD would continue to require inspecting the junction frame with the horizontal stabilizer removed, and would propose to expand the applicability, revise the compliance time and the inspection procedures for inspecting the junction frame, add inspection procedures for certain helicopters, allow repair of the junction frame, and would require modifying and then repetitively inspecting the junction frame and reporting certain information. The actions of this proposed AD are intended to address an unsafe condition on these products.

These proposed AD requirements are as specified in an EASA AD, which is proposed for incorporation by reference (IBR). The FAA is proposing this AD to address the unsafe condition on these products.

The Coast Guard is proposing to establish a temporary safety zone for certain waters of the Menominee River in Marinette, WI within 1000 feet of a blasting area. This action is necessary to provide for the safety of life on these navigable waters during the daily blasting at the southern bank of the Menominee River near the Fincantieri Marinette Marine facility. This proposed rulemaking would restrict usage by persons and vessels within the safety zone. At no time during the effective period may vessels or person pass between the construction barges and southern bank of Menominee River. Also during the entire effective period, vessels are prohibit from transiting the safety zone at speeds that would create a wake. Additionally, during blasting operations, lasting approximately 15 minutes each evening, no person or vessel may enter the safety zone. These restrictions would apply to all vessels during the effective period unless authorized by the Captain of the Port Lake Michigan or a designated representative. The Environmental Protection Agency (EPA) is proposing to approve revisions to the Pinal County Air Quality Control District (PCAQCD or District) portion of the Arizona State Implementation Plan (SIP). These revisions concern the District_s negative declarations for the 2008 8-hour ozone National Ambient Air Quality Standards (NAAQS or ``standards__) in the portion of the Phoenix-Mesa ozone nonattainment area under the jurisdiction of the PCAQCD and two volatile organic compound (VOC) rules covering gasoline dispensing and surface coating operations. We are proposing to approve local rules to regulate these emission sources under the Clean Air Act (CAA or the Act). We are taking comments on this proposal and plan to follow with a final action.

EPA now has sufficient information to determine that the Sumner County Area is attaining the 2010 1-hour SO2 NAAQS and, therefore, is proposing to approve the State_s request and redesignate the Area to attainment/unclassifiable for the 2010 1-hour SO2 NAAQS.

California: Authorization of State Hazardous Waste Management Program Revisions

The Environmental Protection Agency (EPA) approved revisions to California_s federally authorized hazardous waste program by publishing proposed and final rules in the Federal Register on October 18, 2019 and January 14, 2020, respectively. The notice for the proposed rule inadvertently and unintentionally left out citations for approving the State_s authority to adopt additional waste streams as universal wastes in the State Analogues to the Federal Program table. In addition, the scope of the State program that is considered ``broader in scope__ than the federal program was mis-designated. We are proposing to correct these and related errors. EPA seeks public comment prior to taking final action.

The Video Division has before it a petition for rulemaking filed November 27, 2020 (Petition) by Gray Television Licensee, LLC (Petitioner), the licensee of WTOC-TV (CBS), channel 11 (WTOC or Station), Savannah, Georgia. The Petitioner requests the substitution of channel 23 for channel 11 at Savannah, Georgia in the DTV Table of Allotments. In support of its channel substitution request, the Petitioner states that the Commission has recognized that VHF channels have certain propagation characteristics which may cause reception issues for some viewers, and also that the ``reception of VHF signals require larger antennas . . . relative to UHF channels.__ According to the Petitioner, ``many of its viewers experience significant difficulty receiving WTOC-TV_s signal__ and its channel substitution proposal will allow WTOC ``to deliver a more reliable over-the-air signal to viewers. The Petitioner further states that its channel substitution proposal will result in no loss of service. We believe that the Petitioner_s channel substitution proposal warrants consideration. Channel 23 can be substituted for channel 11 at Savannah, Georgia as proposed, in compliance with the principal community coverage requirements of section 73.625(a) of the Commission_s rules at coordinates 32-3-15.0 N and 81-21-0.0 W. In addition, we find that this channel change meets the technical requirements set forth in sections 73.616 and 73.623 of the rules.
